Terms and conditions governing the use of our website and services

These Terms of Use ("Terms") govern your access to and use of the website motovunvillas.com ("Website") and the services offered by:

By accessing or using this Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

2. Services

Motovun Villas provides an online platform for:

  • Browsing information about luxury holiday villas available for short-term rental in Motovun, Istria, Croatia
  • Checking villa availability and seasonal pricing
  • Making online reservations and payments for villa stays
  • Viewing properties available for sale
  • Contacting our team for booking inquiries, investment information, and general questions

3. Booking and Reservation Terms

3.1 Booking Process

A booking is considered confirmed only when:

  1. You have selected your villa, dates, and submitted a reservation through our booking system
  2. The required payment has been successfully processed
  3. You have received a written booking confirmation from us via email

3.2 Pricing

  • All prices are quoted in Euros (EUR) and include all applicable taxes, fees, and charges unless stated otherwise
  • Prices are subject to change without notice for unconfirmed bookings
  • The price at the time of confirmed booking is the final price
  • We offer a Best Price Guarantee — if you find a lower price for the same villa and dates elsewhere, we will match it

3.3 Minimum Stay

A minimum stay of 3 nights is required for all villas, unless otherwise specified for particular periods (e.g., 7 nights during peak season).

3.4 Damage Deposit

A damage deposit of EUR 300 per stay is required, payable in cash upon arrival. The deposit will be returned in full upon departure, provided no damage has occurred to the property or its contents.

3.5 Check-in / Check-out

  • Check-in: from 16:00
  • Check-out: by 10:00
  • Early check-in or late check-out may be available upon request and subject to availability

4. Payment Terms

4.1 Payment Processing

All online payments are processed securely through Stripe, Inc., a PCI DSS Level 1 certified payment processor. By making a payment, you also agree to Stripe's Terms of Service.

4.2 Payment Security

We do not collect, store, process, or have access to your credit card numbers, debit card numbers, or any payment card information. All payment card data is handled exclusively by Stripe using industry-leading encryption and security protocols. Your payment information is transmitted directly to Stripe via encrypted connection (TLS/SSL) and never passes through our servers.

4.3 Payment Methods

We accept payments via major credit and debit cards (Visa, Mastercard, American Express) through our Stripe integration. Additional payment methods may be available depending on your region.

4.4 Payment Schedule

  • A deposit of 30% of the total booking amount is required at the time of booking to confirm your reservation
  • The remaining 70% is due no later than 15 days before the check-in date
  • For bookings made less than 15 days before check-in, the full amount is due immediately

5. Cancellation Policy

  • More than 15 days before check-in: full refund, less any bank or payment processing charges
  • 15 days or less before check-in: no refund
  • No-show: no refund

All cancellations must be communicated in writing via email to dlazukic@motovunvillas.com. We strongly recommend purchasing travel insurance that covers cancellations.

6. Guest Obligations

As a guest, you agree to:

  • Treat the villa and its contents with care and respect
  • Not exceed the maximum number of guests specified in the booking
  • Comply with house rules provided upon arrival
  • Report any damages or malfunctions promptly
  • Not use the villa for commercial purposes, events, or parties without prior written consent
  • Respect neighbours and maintain reasonable noise levels
  • Comply with the no-pets policy (where applicable)
  • Provide valid identification documents for guest registration as required by the Croatian Tourism Act

7. Intellectual Property

All content on this Website — including text, images, photographs, graphics, logos, icons, design elements, and code — is the property of Motovun Villas Management d.o.o. or its licensors and is protected by Croatian and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our prior written consent.

8. Website Availability and Accuracy

  • We strive to keep the Website available and accurate at all times, but we do not guarantee uninterrupted access
  • Villa descriptions, photographs, amenity lists, and pricing information are provided in good faith and are as accurate as possible at the time of publication
  • Minor discrepancies between Website descriptions and the actual property may occur due to seasonal changes, ongoing maintenance, or property improvements
  • We reserve the right to update Website content at any time without prior notice

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Motovun Villas Management d.o.o. shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of this Website or our services
  • Our total liability for any claim shall not exceed the amount paid by you for the specific booking in question
  • We are not liable for events beyond our reasonable control, including but not limited to natural disasters, extreme weather, pandemics, government actions, or utility failures ("force majeure")

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Consumer Rights Under EU Law

As a consumer within the European Union, you are entitled to certain protections under EU consumer law, including:

  • Directive 2011/83/EU (Consumer Rights Directive): you have the right to clear, pre-contractual information about the service, including key characteristics, total price, and cancellation terms
  • Directive 2015/2302/EU (Package Travel Directive): where applicable to combined travel services
  • Right to non-discriminatory access: in accordance with Regulation (EU) 2018/302 (Geo-blocking Regulation)

Please note: as accommodation services are exempt from the 14-day right of withdrawal under Article 16(l) of the Consumer Rights Directive when provided on a specific date, the right of withdrawal does not apply to confirmed bookings. Our cancellation policy (Section 5) applies instead.

11. Online Dispute Resolution

In accordance with Regulation (EU) No 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform for consumers:

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Croatia. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Pazin, Croatia.

For EU consumers: this clause does not affect your right to bring proceedings in the courts of your country of residence, in accordance with applicable EU consumer protection regulations.

13. Links to Third-Party Websites

Our Website may contain links to third-party websites (e.g., Stripe, Google Maps, OpenStreetMap). We are not responsible for the content, privacy practices, or terms of use of those websites. We encourage you to review their policies before providing any personal information.

14. Modifications to These Terms

We reserve the right to modify these Terms at any time. Changes become effective upon publication on this page. Your continued use of the Website after changes constitutes acceptance of the revised Terms. Material changes will be highlighted with an updated "Last updated" date.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
